Official Terms and Conditions for TempStars Chicago Guaranteed Rate Promotion

Promotion Period: Begins November 16, 2023, and continues until 11:59 p.m. Eastern Time ("ET") on December 31, 2023.

Eligibility: Open to legally registered Dental Hygienists and Assistants in Illinois. Participants must hold a valid license, be registered with TempStars, and maintain a track record of consistent reliability (less than 10% shift cancellation rate). Excludes TempStars employees and their immediate family.

Registration for Payment: Free registration with Stripe Express via TempStars platform is required to receive payments. 

Guaranteed Rate Details:

  • Dental Hygienists receive a guaranteed $80/hr, and Dental Assistants $40/hr for completed shifts.
  • Submit offers within $5 of the Recommended Rate.
  • Commit to working shifts without cancelling.
  • After shift completion, invoice the office via TempStars app.
  • TempStars tops up to ensure Guaranteed Rate is met.

Limitations and Restrictions: Enhanced rate and referral incentive valid only during Promotion Period. Cannot be combined with other offers. Subject to shift availability and verification.

Payment Terms: Payments processed through Stripe Express. Participants responsible for tax reporting. Bi-weekly payment efforts by TempStars, subject to banking delays.

Payments: Payments for the enhanced hourly rate and referral bonuses will be processed through the TempStars system via Stripe Express. An active account with Stripe Express is required to receive payments. Efforts will be made on behalf of TempStars' accounting department to ensure payouts are sent on a bi-weekly basis, although banking transfer delays may occur.

Nature of Relationship: The payments made under this promotion are purely promotional disbursements and do not establish an employer-employee relationship between TempStars and the participating talent. Participants in this promotion are independent contractors engaging in a temporary business arrangement with TempStars for the provision of dental services.

Tax Responsibilities: Participants are solely responsible for reporting and paying all related taxes in accordance with federal, state, and local tax laws. The onus of declaring and paying taxes on earnings received from this promotion lies with the participant. TempStars will not make any tax or employment deductions or adjustments from these promotional payments.

Acknowledgement of Contractual Nature: By participating in the promotion, individuals acknowledge and agree that their participation is as independent contractors and not as employees of TempStars. This understanding is crucial in defining the professional relationship between TempStars and the talent, especially concerning tax obligations and employment rights.

Short Notice Cancellation Policy: Compensation policy for office cancellations within 24 hours.

Dispute Resolution: Contact TempStars Member Support. Resolution aimed within 2-3 business days.

Data Privacy: Handled as per TempStars' Privacy Policy and applicable laws.

Modification of Promotion: TempStars reserves the right to modify, suspend, or terminate the promotion.

Liability Release: Participants release TempStars from liabilities related to participation or incentive receipt.

Governing Law: Governed by Ontario and Canadian laws, applicable to participants in Illinois.

Emergency Situations: TempStars may alter operations during emergencies, with communication via various channels.

Marketing Permissions: Consent for use of personal details and images for marketing, with withdrawal option.

Acknowledgement of Understanding: Participation signifies agreement to these terms.

Promotion Period: The TempStars Chicago Dental Hygienist and Assistant Incentive Promotion (the "Promotion") begins November 16, 2023 and continues until 11:59 p.m. Eastern Time ("ET") on December 31, 2023 (the "Promotion Period").

Eligibility: This promotion is open exclusively to legally registered Dental Hygienists and Assistants in Illinois who carry an fully active and qualified license to practice within their scope of the dental profession in Illinois, defined as individuals who hold valid certification or licensure in the state. Participants must be currently registered with TempStars, which entails being active and in good standing on the TempStars platform. Additionally, members must have a "track record of consistent reliability," with a shift cancellation rate less than 10%, characterized by timely and complete fulfillment of scheduled shifts, positive feedback from dental offices, and adherence to state and provincial guidelines for operating a compliant Dental Office. This Promotion is not open to employees of TempStars, their immediate family members, or any persons directly associated with the company.Employees of TempStars, their immediate family members (defined as spouses, children, parents, and siblings), and anyone else directly associated with the company are excluded from participating.  The Guaranteed Rate applies to temping shifts booked and completed through the TempStars service applications and completed on or after November 17, 2023 and on or before December 31, 2023.

Registration for Payment: Participants must register for Stripe Express through the TempStars platform to receive the promotional incentive. This is a free account used to transfer full incentive payments. to ensure payment can be sent, and provide disbursement of the full amount.  It is a mandatory step for the disbursement of the applicable incentive amount. Failure to register for Stripe Express will result in forfeiture of the incentive.

Incentive Details: Eligible Dental Hygienists will receive a guaranteed hourly rate of $80/hr, and Dental Assistants will receive $40/hr for shifts completed during the Promotion Period. How this works:  

  1. When a shift is posted, the participant will see a “recommended hourly rate” when sending an offer for the shift.  Submit your offer within $5 of that Recommended Rate.  

  2. If your offer is accepted, keep your commitment to working that shift without cancelling.

  3. Once the shift is completed, use the TempStars invoicing feature within the app to complete and send your invoice to the office.

  4. The office will pay you according to the shift booking details rate and for the hours worked.

  5. TempStars will have a record in the database of the hourly rate for this shift.  Once the shift is completed, TempStars will send you the amount of funds that would equal the equivalent of the Guaranteed Hourly Rate ($80/hr for RDH participants, $40/hr for Dental Assistant participants.

Referral Incentive: Participants who refer a friend (Dental Hygienist or Assistant) who completes a shift during the Promotion Period will receive a $50 bonus. The referred individual must be a new registrant to TempStars, meaning they have not previously worked shifts through the TempStars platform. The referral must be acknowledged during the new registrant's sign-up process via entering of the Referral Code during sign-up.  The referred individual must complete a full scheduled shift and have their account in good standing with TempStars.

Limitations and Restrictions: The enhanced hourly rate and referral incentive are limited to the Promotion Period. The promotion cannot be combined with other offers or promotions. Participation is subject to shift availability and the operational needs of the dental offices. TempStars reserves the right to audit and verify the eligibility of participants and the validity of the shifts completed.

This is a free account used to transfer full incentive payments. Failure to register for Stripe Express will result in forfeiture of the incentive. Efforts will be made on behalf of TempStars accounting department to ensure payouts are sent on a bi-weekly basis. Any banking transfer delays may be additional.  The participant is not considered and employee of TempStars, and as such, TempStars does not make any tax or employment deductions or adjustments from any Incentives, and it falls solely on the responsibility of the participant to report and pay all related taxes according to their federal, state and local tax laws.

Short Notice Cancellation Policy: In instances where an office cancels a booking with a hygienist or assistant with less than 24 hours' notice, defined as 'short notice', TempStars will endeavor to find a replacement shift. If a replacement is secured, there are no additional obligations. However, if no replacement is found, the office must comply with the short notice cancellation guarantee, compensating the professional for 50% of the scheduled hours, minus half an hour. For example, a cancellation of a 7-hour shift on short notice would entail a compensation of 3 hours (calculated as 7 hours x 0.5 = 3.5 hours, minus 0.5 hours). This policy is a mandatory requirement for all offices using TempStars services, and failure to comply can result in penalties. While TempStars facilitates the connection between dental offices and professionals, it does not bear the financial responsibility for the office's cancellations. Specifically, TempStars is not responsible for 'topping up' the short notice cancellation guarantee as part of any promotional activities. In case of disputes, TempStars will provide support, yet the final financial obligation remains with the office. To claim the guarantee, the affected professional must promptly notify TempStars, following which the office is obligated to process the guarantee payment directly within a specified timeframe. TempStars reserves the right to modify this policy as needed, with any changes communicated to all registered participants.

Dispute Resolution: Any disputes or inquiries related to the promotion will be addressed by TempStars Member Support at https://support.tempstars.com/hc/en-us with an aim to resolve disputes within 2-3 business days. Participants agree that unresolved disputes shall be resolved individually, and TempStars reserves the right to determine the method of resolution, which may include arbitration at a location specified by TempStars and under specified rules.

Data Privacy: Participant information will be handled according to TempStars' Privacy Policy and applicable data protection laws, ensuring confidentiality and security of personal data.

Modification of Promotion: TempStars reserves the right to modify, suspend, or terminate the promotion at any time, with changes communicated through the TempStars platform or via email to registered participants.

Liability Release: By participating, individuals release TempStars and its affiliates from any claims or liabilities arising from participation in the promotion or the receipt/use of the incentive.

Governing Law: The promotion is governed by the laws of the Province of Ontario and the federal laws of Canada, without giving effect to any choice of law or conflict of law rules or provisions. Acknowledgement of Understanding: By participating in the promotion, individuals acknowledge and agree to these rules and regulations.

Emergency Situations: In the context of these terms and conditions, an 'Emergency Situation' is defined as any unforeseen event that poses immediate risks, such as natural disasters, medical crises, fires, or acts of terrorism. In such instances, TempStars reserves the right to alter, suspend, or terminate operations without prior notice to ensure the safety of all parties involved. TempStars will not be liable for any failure or delay in fulfilling its obligations under these terms due to Emergency Situations beyond its control. During emergencies, TempStars commits to keeping customers and partners informed through various communication channels, including email, social media, and its website. Post-emergency, TempStars aims to swiftly and safely resume normal operations, assessing the impact of the emergency and taking necessary actions to restore services and support affected parties. Customers are required to adhere to all emergency procedures and instructions issued by TempStars or relevant authorities to ensure collective safety. Additionally, TempStars may amend these terms in response to an Emergency Situation, with such amendments communicated to customers as efficiently as possible, tailored to the unique challenges of the emergency.

Marketing Permissions: By participating in the promotion, members consent to TempStars using their personal details, including names, success stories, and involvement in promotional activities, for marketing purposes. This consent extends to the utilization of these details in various promotional outputs aimed at enhancing TempStars' brand visibility and audience engagement. Additionally, participants agree to the potential use of their photographic images on TempStars’ social media platforms and other marketing materials, subject to explicit, individual consent for each use. This means that TempStars will request and require separate approval for each instance where a participant’s image is planned to be used, ensuring respect for participant privacy and image rights. Participants can withdraw this consent at any time by notifying TempStars in writing, although it is noted that previously circulated or published materials will not be retracted. TempStars is committed to adhering to stringent data protection laws and its own Privacy Policy, ensuring the safety and privacy of all participant data. This includes upholding the rights of participants to access, review, and correct their personal information held by TempStars.

Liability Release: Participants release TempStars, its officers, directors, employees, and agents from any claims, damages, or liabilities arising from or related to participation in the promotion or acceptance/use of any incentive.

Acknowledgement of Understanding: By participating in the promotion, members acknowledge that they have read, understood, and agreed to be bound by these rules and regulations, including any modifications and additional terms.
