TempStars Ontario Reactivation Promotion Terms and Conditions

Promotion Period: The TempStars Ontario Reactivation Promotion (the "Promotion") begins at 12:00 a.m. Eastern Time ("ET") on November 10, 2023, and ends at 11:59 p.m. ET on December 31, 2023 (the "Promotion Period").

Eligibility: This promotion is exclusively available to dental office businesses within Ontario, Canada ("Eligibility Area"). The promotion is designed as a reactivation campaign for dental offices that have been inactive or churned, specifically targeting those who have not posted a shift on the TempStars platform for more than 90 days before the promotion announcement/launch.

Employees of TempStars, their immediate family members, or persons directly associated with the company are not eligible to participate in this Promotion.

Promotion Details: Eligible dental offices must post a minimum of three (3) shifts during the Promotion Period. Upon the completion of one shift within 2023, TempStars will waive its placement fee for that shift. This waiver applies only to the TempStars placement fee and does not cover the Talent's service rate.

Limitations and Restrictions: The incentive is limited to one free shift per eligible dental office location. The promotion cannot be combined with other offers and is subject to the availability of Dental Hygienists and Assistants. TempStars reserves the right to modify or substitute the incentive in certain circumstances.

Incentive Fulfillment: Eligibility and incentive fulfillment will be automatically determined and processed through the TempStars database. No purchase is necessary to participate.

Dispute Resolution: Participants should contact TempStars Member Support at TempStars Support for disputes related to the promotion. TempStars aims to resolve disputes within 1-2 business days. Any unresolved disputes shall be resolved individually.

Data Privacy: Participating dental office data will be handled in accordance with TempStars' Privacy Policy and applicable data protection laws.

Modification of Promotion: TempStars reserves the right to modify or cancel the promotion at any time, with changes communicated through the TempStars platform or via email.

Governing Law: The promotion is governed by the laws of the Province of Ontario and the federal laws of Canada.

Acknowledgement of Understanding: By participating in the promotion, participants acknowledge and agree to these rules and regulations.

Promotion Period: The TempStars Surge Season Promotion (the "Promotion") begins at 12:00 a.m. Eastern Time ("ET") on November 10, 2023, and ends at 11:59 p.m. ET on December 31, 2023 (the "Promotion Period").

Eligibility: Open to legal residents of Illinois and Ontario ("Eligibility Area"), who as of the date of entry are dental office members of TempStars. To be eligible, dental offices must hold a "membership in good standing," defined as having a membership status of “Active”, adhering to all TempStars policies and procedures, and not being subject to any active or ongoing disciplinary actions with any dental licensing bodies. Additionally, dental offices must have a "track record of consistent reliability," with a shift cancellation rate less than 10%, characterized by timely and complete fulfillment of booked shifts, and adherence to state and provincial guidelines for operating a compliant Dental Office. Furthermore, for dental offices in Ontario, eligibility is conditional upon not having completed a shift on or before August 1st, 2023. This Promotion is not open to employees of TempStars, their immediate family members, or any persons directly associated with the company.

Limitations and Restrictions: Incentives are limited to one per member account unless otherwise stated in the promotion-specific communications. The promotion may not be combined with other offers and is subject to the availability of Dental Hygienists and Assistants. TempStars reserves the right to substitute the incentive with one of equal or greater value in certain circumstances.

Incentive Terms: This promotion is open to offices in Ontario, provided they have not completed a shift on or before August 1, 2023, and all offices in Illinois. Eligible offices must post a minimum of 3 shifts on the TempStars platform for dates up to and on December 31, 2023. The first shift completed within the promotional period, which extends until December 31, 2023, will be free of charge. Eligibility and incentive fulfillment will be automatically determined and processed through the TempStars database, with no purchase necessary to participate.

Dispute Resolution: For disputes related to the promotion, participants should contact TempStars Member Support at https://support.tempstars.com/hc/en-us. TempStars aims to resolve disputes within 1-2 business days. Participants agree that any unresolved disputes shall be resolved individually, without resort to any form of class action.

Additionally, participants agree to the potential use of their photographic images on TempStars’ social media platforms and other marketing materials, subject to explicit, individual consent for each use. This means that TempStars will request and require separate approval for each instance where a participant’s image is planned to be used, ensuring respect for participant privacy and image rights. Participants can withdraw this consent at any time by notifying TempStars in writing, although it is noted that previously circulated or published materials will not be retracted. TempStars is committed to adhering to stringent data protection laws and its own Privacy Policy, ensuring the safety and privacy of all participant data. This includes upholding the rights of participants to access, review, and correct their personal information held by TempStars.

Liability Release: Participants release TempStars, its officers, directors, employees, and agents from any claims, damages, or liabilities arising from or related to participation in the promotion or acceptance/use of any incentive.

Emergency Situations: In the context of these terms and conditions, an 'Emergency Situation' is defined as any unforeseen event that poses immediate risks, such as natural disasters, medical crises, fires, or acts of terrorism. In such instances, TempStars reserves the right to alter, suspend, or terminate operations without prior notice to ensure the safety of all parties involved. TempStars will not be liable for any failure or delay in fulfilling its obligations under these terms due to Emergency Situations beyond its control. During emergencies, TempStars commits to keeping customers and partners informed through various communication channels, including email, social media, and its website. Post-emergency, TempStars aims to swiftly and safely resume normal operations, assessing the impact of the emergency and taking necessary actions to restore services and support affected parties. Customers are required to adhere to all emergency procedures and instructions issued by TempStars or relevant authorities to ensure collective safety. Additionally, TempStars may amend these terms in response to an Emergency Situation, with such amendments communicated to customers as efficiently as possible, tailored to the unique challenges of the emergency.

Acknowledgement of Understanding: By participating in the promotion, members acknowledge that they have read, understood, and agreed to be bound by these rules and regulations, including any modifications and additional terms.
